Cuba: License Exception SCP III

In addition to elements discussed in prior posts, the Commerce Department’s new License Exception SCP to its Export Administration Regulations (the “EAR”) also seeks to improve communications between Cubans and the outside world by authorizing unlicensed exports/reexports to Cuba of:

  • sold or donated items for telecommunications, including access to the Internet, use of Internet services, infrastructure creation and upgrades;
  • items for use by news media personnel engaged in the gathering and dissemination of news to the general public and who are:

o   regularly employed as journalists by a news reporting organization;

o   regularly employed as supporting broadcast or technical personnel;

o   freelance journalists with a record of previous journalistic experience working on a freelance journalistic project; or

o   broadcast or technical personnel with a record of previous broadcast or technical experience who are supporting a freelance journalist + Add New Categoryworking on a freelance journalistic project; and

  • items for use by U.S. news bureaus engaged in the gathering and dissemination of news to the general public.
